Disputes

The present disclaimer is drawn up in accordance with French law, and in particular with the provisions of the law of June 21, 2004 on confidence in the digital economy and the law of January 6, 1978 as amended by the law of August 6, 2004 on information technology and civil liberties. The French courts have territorial jurisdiction to hear any dispute relating to the Site.

TERMS AND CONDITIONS FOR THE USE OF THE FOLIES GRUSS RADIO APPLICATION

Play Console terms of use

Effective April 29, 2020

1. Applicable conditions

1.1 Thank you for using Play Console. Play Console is a service offered to developers at the following address https://play.google.com/apps/publish by Google LLC, a Delaware limited liability company whose principal place of business is 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; Google Ireland Limited, a company registered in Ireland whose principal place of business is Gordon House, Barrow Street, Dublin 4, Ireland; Google Commerce Limited, a company registered in Ireland whose principal place of business is Gordon House, Barrow Street, Dublin 4, Ireland; or Google Asia Pacific Pte. Limited, a company registered in Singapore whose principal place of business is 70 Pasir Panjang Road, #03-71, Mapletree Business City, Singapore 117371. These Google entities (collectively referred to herein as “Google” or “we”) and their respective addresses are subject to change. Your individual use of Google Play Console is subject to these Google Play Console Terms of Use (the “Terms”).

1.2 To accept the Terms and use the Play Console, You must be at least 18 years of age and of legal age in Your country to be bound by a contract with Google.

1.3 These Terms legally bind You to Google in connection with Your use of the Play Console.

1.4 These Terms supplement the Google Play Developer Distribution Agreement currently available at https://play.google.com/intl/ALL_fr/about/developer-distribution-agreement.html (the “DDAA”). You must accept the CRDD in order to use the Play Console.

1.5 The term “Play Console” includes the various versions of Play Console (Web, Mobile Web and Application) that may be made available to You by Google. The Play Console offers management, publishing and referencing tools, as well as statistics and analysis based on performance data for applications associated with the Developer Account, on Google Play and the Android operating system.

2. Definitions

Capitalized terms not defined in these Conditions shall have the meaning ascribed to them in the CRDD.

Account holder: the user who initially created the Developer Account.

Play Console User: any user of the Developer Account other than the Account Holder.

You (see also “Your”, “Vos”): refers to any individual user of the Play Console, whether as an Account Holder or as a Play Console User.

3. Confidentiality and collected data

3.1 All data collected or used in connection with Your use of the Play Console will be treated in accordance with the Google Privacy Policy. In addition, certain special cases explained below apply to data that Google collects in connection with the Play Console.

3.2 When You use the Play Console or the Google Play Developer APIs (available at https://developer.android.com/google/play/developer-api), Google collects certain “Usage Information”. The term “Usage Information” refers to information about Your use of the Play Console, such as Your page visits and data views, Your interactions with Play Console features (including those related to the management of Developer Account applications), Your actions when using the Google Play Developer APIs and Your Play Console login email address, as well as IP addresses and timestamps associated with these activities. Google associates this Usage Information with the Developer Account.

3.3 All Usage Information collected by Google may be shared with the Account Holder, inter alia, to enable the Account Holder to manage the Developer Account, including monitoring user actions and detecting potential abuse.

3.4 In the event that Applications are transferred to a new Developer Account, all Usage Information relating to such Applications shall be associated with the new Developer Account and may be shared with the Account Holder of the new Developer Account, as described in Section 3.3.

3.5 Google will retain Usage Information for as long as the associated Developer Account is active. Any change affecting Your ability to access Play Console or Your login credentials (including deactivation) will have no effect on this retention period.

4. Restrictions on use

You cannot use Play Console :

  • for any action not provided for in the functionalities of the Play Console, as described in the Conditions and in other documents relating to the Play Console;
  • for the practice of illegal activities, as well as for incitement to abusive behavior or the glorification of such behavior;
  • to disable, interfere with, reverse-engineer or circumvent any aspect of Play Console; or
  • to access any other Google product or service in violation of the Terms of Use for that product or service.

5. Modification and termination of services

5.1 Google may, in its sole discretion, modify, discontinue or limit access to any Play Console feature or functionality, including statistical reporting, for any reason and at any time, without liability to You or the Account Holder.

5.2 If Google terminates the Play Console service, Google will provide You with reasonable advance notice where practicable. If Google removes a prominent statistic or reporting feature, Google will endeavor to provide at least thirty (30) days’ written notice, either through a message in the product itself or through an e-mail, blog post or other reasonable means.

5.3 Google may modify the Terms at any time by providing notice to You, giving You the opportunity to opt-out and no longer use the Play Console. Google will post changes to the Terms on the Play Console website(play.google.com/console) and send them to Your e-mail address. Changes are not retroactive. They become effective and are deemed accepted by You, (a) immediately for persons who became Account Holders or Play Console Users after the notification was published, or (b) for pre-existing Account Holders and Play Console Users, on the date specified in the notification, at least thirty (30) days after the publication of the changes (except for changes concerning new Play Console features or changes required by law, which become effective immediately).

5.4 If You do not agree with any changes to the Terms, You must cease using the Play Console, which shall be Your sole and exclusive remedy. You acknowledge that Your continued use of the Play Console constitutes Your acceptance of the changes to the Terms.

5.5 In the event of non-compliance with the Terms, Google reserves the right to disable Your access to the Play Console. In addition, to the extent permitted by law, Google may disable Your access for any reason upon thirty (30) days prior written notice.

6. General legal conditions

6.1 The applicable law and jurisdiction specified in the SDRC shall apply to all claims arising out of or relating to the Terms or Your relationship with Google under the Terms.

6.2 These Terms, the Google Play Developer API Terms of Use (if You use the Google Play Developer APIs) and the SDRC constitute the entire legal agreement between You and Google, and govern Your use of the Play Console. They supersede any prior agreements between You and Google with respect to Play Console. The English version of these Terms prevails. Any translation is non-binding and provided for informational purposes only. In the event of any conflict between these Terms, the Google Play Developer API Terms of Use and the SDRC, these Terms shall prevail.

6.3 Sections 2 (Definitions), 3 (Confidentiality and collected data) and 6 (General legal conditions) shall survive the expiry or termination of these Conditions.
